2. Refund & Cancellation Policy (Reconciled)

*This policy resolves the previous contradiction between a “30-day guarantee” and “non-refundable” clauses. The determining factor is whether the service has been migrated to your server.*

2.1 Core Principle

Because our services are digital and include migration to your server, refund eligibility depends on how much of the service has been completed.

2.2 Full Refund – Eligible (Before Server Migration)

You are eligible for a full refund if ALL of the following are true:

You request a refund within 30 days of the original order date.
AND we have not yet migrated the completed work to your live server or hosting environment.
Reason: Dissatisfaction, change of mind, non-delivery, or product not as described.

How to request: Contact info@nyctechservices.com. Refunds are issued to the original credit/debit card within 30 working days.

2.3 No Refund – Service Final (After Server Migration)

Once the digital service (website, design, software, configuration, or any deliverable) has been migrated and delivered to your server or live environment, the service is considered FINAL and NON-REFUNDABLE.
Digital goods cannot be “returned” after installation on your infrastructure. By approving migration, you confirm acceptance of the work.

2.4 Specific Circumstances

2.5 Major Defects Process

Report the defect to our Technical Support Team at info@nyctechservices.com.
We have 72 hours to correct it.
If we fail to correct it within 72 hours and the service has not yet been migrated, a full refund will be issued.
If migration has already occurred, we will repair the defect but no refund will be given.

2.7 General Refund Notes

All refunds are issued to the original credit or debit card as provided.
Refunds take a maximum of 30 working days to process.
The customer needs to specify the details of the account and reason to the associates, after which we will proceed as per requirements.
NYC TECH SERVICES management reserves the right to reject fraudulent or abusive refund requests.

3. Restrictions on Use of Materials

You may not:

Copy, print, or reproduce any text, graphics, databases, HTML code, or other intellectual property
Republish, re-engineer, translate, host, or distribute any materials by any means without explicit permission
Use our intellectual property for commercial purposes without authorization

All trademarks are property of their respective owners and used with permission.

4. No Business Opportunity Claim

The products and services provided on this site are for education and entertainment purposes only.

No money will be made simply by requesting the information, products, or services.
This site is not offering a business opportunity of any kind.
Additional product purchases may be required to start your own business.
Recommendations are provided for your consideration; you are under no obligation to purchase any other products or join any opportunity.
All decisions are of your own educated intellect and made of your own free will.

Good Faith Negotiation: If a dispute arises, we agree to first try to resolve it in a timely manner through direct negotiation.
Mediation (if needed): If negotiation fails, we agree to submit the dispute to a mutually agreed-upon mediator. Any costs and fees other than attorney fees associated with mediation will be shared equally.
Binding Arbitration (if needed): If mediation fails, we agree to submit the dispute to binding arbitration within the United States. Judgment upon the award rendered by arbitration may be entered in any court with jurisdiction to do so.

Exception for Intellectual Property: To the extent you have violated or threatened to violate our intellectual property rights, we may seek injunction or other appropriate relief in any state or federal court in the United States, and you consent to exclusive jurisdiction and venue in such courts.

10. Termination

These Terms of Use are effective until terminated by either party.

You may terminate this agreement at any time by destroying all materials obtained from any and all this Site and all related documentation and copies thereof.

We may terminate this agreement immediately without notice at our sole discretion if you fail to comply with any term or provision. Upon termination, you must destroy all materials obtained from this Site and all copies thereof.

11. Other Legal Provisions

Revisions: We reserve the right to issue revisions to these Terms of Use by publishing a revised version on this site. The revised version will apply to all use by you following the date of publication.
